Minimum Wage claims are the topic of a recently filed class action against Prevent Life Safety Services, Inc. Last week, Zakay Law Group filed an employment class action against the Defendant, also known as Prevent LSS in San Diego, California.
The Plaintiff filed the Complaint on November 13, 2018 with the California Superior Court in San Diego. The Plaintiff was an hourly, non-exempt employee who worked for the Defendant all over California. The Plaintiff, who worked for Prevent LSS for more than two years is now challenging the company’s minimum wage policies.
Specifically, the Plaintiff claims in the complaint that Prevent LSS implemented a policy that required Plaintiff and other employees to travel long distances while off the clock. As a result, Plaintiff traveled for the company around California without being paid minimum wage for his travel time. Furthermore, the complaint alleges that the failure to pay minimum wages for the travel time resulted in unpaid overtime and missed or late meal breaks and rest breaks.
The complaint was filed as a proposed class action on behalf of the Plaintiff and all other employees who worked for the Defendant in California as hourly, non-exempt employees. The complaint contends that Defendant violated multiple labor codes, including, among others: (1) failure to pay minimum wage; (2) failure to pay overtime; (3) failure to provide required meal breaks; (4) and failure to provide required rest breaks.
The class action also claims that the above violations resulted in inaccurate pay statements and in failure to pay accurate wages when due in violation of the California labor code. Finally, the complaint contends that these violations also constitute an unfair business practice in violation of the California Business and Professions Code.
The action is seeking monetary damages on behalf of Defendant’s current and former employees for the unpaid wages and related penalties. The action is also seeking an injunction to force the Defendant to comply with the law.
