Nurses and other hourly employees filed a lawsuit last month against their California employer. The Complaint was filed by 6 employees who worked in California for the Defendant since 2017. The defendant are Stat Med Professional Corporation and Urgent Care Partners, Inc.
The Defendants provide immediate care, preventive care, employee health services and other patient care services in four different locations in North California. The Plaintiffs worked for the California employer between 2017 and 2019 at various positions, including nurses, nurse assistants, secretaries, and other hourly, non-exempt position.
The employment lawsuit was filed in Superior Court of the State of California in the County of Alameda on November 14, 2019. The nurses and other employees filed the lawsuit on behalf of themselves, but also on behalf of all other non-exempt employees who worked for Stat Med Professional Corporation and/or Urgent Care Partners, Inc. in California since November 2015. The employees are represented by California employment attorney Shani O. Zakay of Zakay Law Group, APC, and Nicholas J. De Blouw of Blumenthal Nordrehaug Bhowmik De Blouw, LLP.
The legal action alleges 9 different causes of action on behalf of the nurses and against the employer, including claims for unpaid minimum wages, unpaid overtime wages, missed meal breaks, missed rest breaks, inaccurate wage statements, and failure to pay wages on time. The lawsuit also alleges a claim for violations of the Private Attorneys General Act (PAGA), as well as unfair business practices under the California Business and Professions Code.
The nurses allege, as their main contention, that Stat Med Professional Corporation and Urgent Care Partners, Inc. required them to stay at their desk and work during what should have been their 30-minute meal breaks. They further claim that they often performed work for their employer before and after their shifts, without pay to compensate them for their time.
The lawsuit seeks monetary damages to compensate the nurses and other employees for the unpaid wages they are allegedly owed, as well as for the missed meal breaks and rest breaks. The lawsuit further seeks monetary penalties for the various California labor code violations alleged in the complaint. Finally, the lawsuit seeks a Court order compelling Stat Med Professional Corporation and Urgent Care Partners, Inc. to comply with California employment laws.
