Unpaid Overtime claims are again at issue in a recently filed employment class action. The case of McIntyre v. J.J.R. Enterprises, Inc. was filed on February 25, 2019. The California employment law firm of Zakay Law Group filed the case in the Sacramento Superior Court, along with another employment law firm–Blumenthal, Nordrehaug, Bhowmik, De Blouw, LLP.
The Plaintiff brought her employment claims in Sacramento, California, on behalf of herself, but also on behalf of all other hourly employees who worked for the Defendant in California during the past 4 years. The lawsuit is, therefore, an employment class action, and also a representative action.
The Defendant in the action is J.J.R. Enterprises, Inc., better known as Caltronics Business Systems. Caltronics sells document management software and hardware throughout California and other states.
The lawsuit claims that Caltronics paid the Plaintiff and other hourly employees various commissions and bonuses, but failed to incorporate those into the employees’ overtime rate. The action contends, therefore, that many of the company’s California employees were the subject of unpaid overtime, or at least underpaid overtime.
In addition to the unpaid overtime claims, the complaint also alleges that the Defendant failed to provide Plaintiff and other hourly employees with proper meal breaks and rest breaks. Finally, the complaint argues that these violations resulted in inaccurate wage statements and late payments, leading to additional liability under the California Labor Code. In addition to those California Labor Code violations, the action sets forth claims under the Private Attorneys General Act (PAGA), and the California Business & Professions Code.
The lawsuit seeks monetary damages for the unpaid overtime and missed breaks. The lawsuit also seeks monetary penalties, and a court order compelling Caltronics to bring its employment practices into compliance with California employment laws.
